STALLION SERVICE CONTRACT FOR COOLED SHIPPED SEMEN

This certifies that __________________________________ (mare owner/Purchaser has) confirmed a reservation for transported semen collected from the stallion, ______________________

for the mare, ___________________________, Reg. No. ____________________ Breed ___________ Age___________, for the 2005 season at a breeding fee of $_________________________

This contract is subject to the following:

1. Upon payment of a $250.00 booking fee, which is non-refundable, Stallion Owner does hereby reserve for the Mare Owner one season’s booking for 2005 to _________________ for the service of the Mare.

2. The balance of $_______ will be paid before the semen is shipped.

3. Mare owner agrees to abide by FW Quarter Horses Procedural Guidelines for Breeding with Transported Semen.

4. Stallion Manager assumes responsibility only to deliver live semen in a viable condition at the time of delivery to the Mare Owner’s Farm. Stallion Manager agrees to ship a maximum of two whorl packs of live semen in a viable condition per cycle, for a maximum of three cycles or until the end of the breeding season, which ever occurs first.

5. If Mare does not conceive with the first shipment, FW Quarter Horses will provide another shipment of semen to mare. Owner is responsible for the payment of the 2nd freight charges whether it being Fed X or Air Transport. There will be an added collection fee of $100.00 that must be paid upon receipt.

6. FW Quarter Horses Live Foal Guarantee (with return the following season only) from the semen contracted on the stallion named in this contract. A live foal is described as a newborn foal that stands and nurses without assistance. FW Quarter Horses, stallion managers, stallion owner and/or agents will not be liable for any infectious, transmittable or inheritable diseases or conditions to the foal resulting from this breeding.

7. If the mare is checked in foal and later aborts or fails to produce a live foal, the live foal guarantee will be void unless the mare owner/purchaser notifies FW Quarter Horses by telephone or fax within 48 hours after the mares death, and within 15 days thereafter furnishes a certificate by a licensed veterinarian substantiating the death and specifying the full particulars as to cause.

8. It is agreed that should the above names stallion die or become unfit for service, or if mare dies or becomes unfit to breed, then this contract shall become null and void and the booking fee refunded. For those with a return breeding from last year, if the stallion dies the mare owner may select another stallion with all monies paid applied to that stallion’s breeding fee. If the mare dies the mare owner may substitute another mare to be bred. There will be no money refunded.

9. This contract is not transferable or assignable. There shall be no right of return to the stallion if the mare named in this contract is sold or otherwise changes ownership after being serviced by the stallion except at the discretion of the stallion owner or FW Quarter Horses.

10. A breeder’s certificate will be issued to mare owner/purchaser after all expenses have been paid in full and upon notification of the birth of the foal.

11. FW Quarter Horses is not responsible for lost, delayed or damaged semen and make no representation or warranties of any kind with respect to any semen furnished to mare owner/purchaser except that the semen shipped is from the stallion named in this contract.

12. A Photostat copy of the mares registration certificate must be return with this contract as one of the requirements.

13. Charges for returning the equitainer to FW Quarter Horses is the Mare Owners responsibility.

14. Mare Owner understands that FW Quarter Horses requires the equitainers returned within 3 days of receiving the shipment. If not returned before then, there will be a penalty of $10.00 per day, until the container arrives back at the breeding farm.

15. When FW Quarter Horses signs and returns one copy of this contract to mare owner, it will be a binding contract on both parties, subject to the terms and conditions as set forth of this contract.

16. As of 2005, FW Quarter Horses will be offering our American customers same day service via Air travel. This service is not included in the Stallion Service fee do to the cost of having to hire a driver in Vancouver to run it across the border. Cost of this $200.00.

I hereby agree to these terms and condition as set forth in this contract.
